End User Terms

1. Introduction

  • 1.1 These dunnhumby Key Performance Report User Terms (“End User Terms”) apply to your access to and use of dunnhumby Key Performance Report “dunnhumby KPR”.
  • 1.2 dunnhumby KPR is operated by dunnhumby Limited ("we", "us" or "our").
  • 1.3 Where we say "you" or "your" in these End User Terms, this means the person accessing and using dunnhumby KPR. This doesn't mean the organisation which has registered with us to access and use dunnhumby KPR and which has authorised you to access and use dunnhumby KPR – we have a separate contract with that organisation, which will usually be the organisation which employs or engages you, which we call "our Client".

 

2. Accepting these End User Terms

  • 2.1 Please read these End User Terms carefully before you sign-up to dunnhumby KPR or access or use dunnhumby KPR.
    • If you accept these End User Terms, and agree to comply with them, together with any other terms and conditions, notices and policies referred to in them, please click the tick box to confirm acceptance and continue in the dunnhumby KPR sign-up process.
    • If you do not accept these End User Terms, or any of the other terms and conditions, notices and policies referred to in them, please do not click the tick box to confirm acceptance or continue in the dunnhumby KPR sign-up process.

 

3. Other Notices, Policies and Terms and Conditions

  • 3.1 You must read the dunnhumby KPR Privacy Notice regarding our use of your personal data. By accepting these End User Terms, or by accessing or using dunnhumby KPR, you are confirming that you understand that we will use your personal data in the way described in the dunnhumby KPR Privacy Notice.
  • 3.2 Please also read (i) the dunnhumby KPR Terms & Conditions – these are the terms and conditions which apply to the contract between us and our Client for dunnhumby KPR and govern our and our Client's overall responsibilities; and (ii) the dunnhumby Acceptable Use Policy – this sets out restrictions and limitations on what purposes dunnhumby KPR can be used for.
  • 3.3 You must comply with any restrictions and limitations on access and use of dunnhumby KPR set out in the dunnhumby KPR Terms & Conditions and the dunnhumby Acceptable Use Policy. Our Client should explain these to you before you access or use dunnhumby KPR – if not, please speak to our Client directly.
  • 3.4 Failure to comply with the restrictions and limitations on access and use of dunnhumby KPR set out in the dunnhumby KPR Terms & Conditions and the dunnhumby Acceptable Use Policy may lead to us suspending your account without notice or, ultimately, termination of the contract between us and our Client for dunnhumby KPR.
  • 3.5 Each of these notices, policies and terms and conditions may be updated from time to time, so you must ensure that you check for any changes on a regular basis. Any updated versions will replace all previous versions.

 

4. Changes to these End User Terms

  • 4.1 We can update these End User Terms at any time.
  • 4.2 If we make any material updates, we will tell you about the changes by posting updates or an updated version on the dunnhumby KPR website or on dunnhumby KPR, or we may send you an email. Any updated version of these End User Terms replaces all previous versions. If you continue to access or use dunnhumby KPR after any updates to these End User Terms, you will be deemed to have accepted these updates.

 

5. Changes to dunnhumby KPR

  • 5.1 We can change dunnhumby KPR at any time, so you may see new features and you may also see that some features change or are no longer available.
  • 5.2 You can only download or export reports and analyses from dunnhumby KPR while our Client’s subscription is active, so if there’s a particular report or analysis that you want, we would recommend exporting a copy of that report or analysis. just in case the tools, features or data which support that report are no longer available.

 

6. Your Account

  • 6.1 Your account log-in credentials are confidential. You must not show them to anybody or share them with anybody else, other than sharing your email address with us where necessary to deal with an issue you have experienced with dunnhumby KPR.
  • 6.2 You acknowledge that we may suspend your access to dunnhumby KPR on occasion without notice for a number of reasons, for example if there is a security issues or to perform maintenance.

 

7. How we protect your personal data

All Intellectual Property Rights in dunnhumby KPR are owned by us, a member of our group or our licensors.

 

8. Contacting Us

If you become aware of any breach of these End User Terms or any unauthorised access to or use of your log-in credentials, you must report this immediately to legal@dunnhumby.com.

 

9. Information and Third Party Sites

  • 9.1 Any information which we make available on dunnhumby KPR is not intended to amount to advice on which you should rely. You must exercise your own judgement in deciding whether to rely on the information which is generated by dunnhumby KPR.
  • 9.2 Where dunnhumby KPR contains links to other sites and resources provided by third parties, these links are provided for your information only and we are not responsible or liable for these sites or resources.

 

10. Applicable Law and dunnhumby

  • 10.1 These End User Terms and any disputes and claims related to these End User Terms are subject to the laws of England and Wales and the exclusive jurisdiction of the English courts.
  • 10.2 Where we refer to "dunnhumby" in these End User Terms, this is be a reference to dunnhumby Limited.
